US Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the court noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Case
The court challenge involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in Tennessee.

The court, who was hearing his challenge to deportation in a federal court, determined that he must now comply with the conditions of his bond from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
